1. PREAMBLE

 SAVIN'SKIN is the trade name of S.C. SAVINVIBE S.R.L.  ("The Company") registered with the Bucharest Trade Register under no.  J40/10857/2019, C.U.I.  RO41531956, with the registered office in Bucharest, Sector 4, Str. Mitropolitul Nifon nr.13, Et.2, Ap. 8.

The terms and conditions of use ("TCU") set forth below in conjunction with any associated or included document govern the access to and use of the website www.savinskin.com,  including access to the newsletter, content, functionality, and services offered on or through www.savinskin.com further referred to as "Website".

The Website is offered and available to users who have reached the age of 16.  By using the Website you warrant that you are of legal age and the ability to contract the services offered by the Company and meet all previous eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Please read the TCU carefully before you start using the Website. If you do not agree with the TCU or with the Privacy Policy, you must not access or use the Website.

By reading the TCU you accept, as a User or Buyer, that you have been informed, in a clear and comprehensible manner by the Company, prior to the signing of a distance contract (the "Contract"), at least of the following aspects:

• the main characteristics of the Products and services;
• the identity of the Company, including its name and address;
• the total price of the Products with all taxes included and payment methods, the term of delivery or provision of services, the method of solving complaints;
• the conditions, terms, and procedures for exercising the right of return to sender, if this right is provided, the obligation of the Buyer to pay the return fees in case of cancellation of orders, as well as the standard form of return; if the right of return to sender is not provided, the information according to which the Buyer will not benefit from a right of return or the circumstances in which he loses his right of return to sender;
• information on legal warranty;
• the duration of the validity of the Contract;
• the conditions of termination of the Contract.

The TCU may be reviewed and/or updated by the Company as it deems necessary at any given time. The additions and/or modifications made to the TCU are effective and are applicable immediately after their posting on the Website. Changes to the TCU in connection with dispute resolution are not applicable to disputes notified prior to the date of their posting on the Website.

Your continued use of the Website after the publication of the TCU, as amended, constitutes your agreement to these changes.

We recommend users and Buyers periodically check the TCU so that they are aware of any changes to them.

In case of violations of the TCU provisions by Users or Buyers, the Company reserves the right to restrict access to the Website and Services immediately and irrevocably without prior notice.

If the Company finds violations of the TCU and has not yet taken any action regarding these violations, it does not mean that by doing so the Company has waived its right to take such measures and/or to claim damages.

 

 

TERMS AND CONDITIONS OF USE

1. DEFINITIONS

 

Products and Services	:	any product or service displayed on the Website that may be the subject of an Order
Campaign	:	The action of displaying for commercial purposes, a finite number of Products and/or Services having a limited and predefined stock, for a limited period of time established by the Company.
Account	:	This section of the Website consists of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client / Buyer and the Buyer's history on the Website (Orders, tax invoices, guarantees, Goods, etc.). The Customer/Buyer is responsible and will ensure that all information recorded when creating the Account is accurate, complete and up-to-date.
Command	:	An electronic document that intervenes as a form of communication between the Company and the Buyer through which the Buyer transmits to the Company, through the Website, his decision to purchase products and services from the Website.
Comment	:	critical appraisal or observation in the margins of a Review or other comment.
Content	:	·               information on the Website that can be visited, viewed or otherwise accessed by using an electronic device; ·               the content of any e-mail sent to Buyers by the Company by electronic means and/or any other means of communication available; ·               any information communicated through any means by an employee/collaborator of the Company, to the Buyer, according to the contact information, specified or not by the sender; ·               information related to the Products and/or Services and/or the prices/tariffs practiced by the Company during a certain period; ·               information about the Products and/or Services and/or the prices and tariffs charged by a third party with whom the Company has concluded partnership agreements, within a certain period of time; ·               data relating to the Company, or other privileged data thereof.
Contract	:	represents the remote contract concluded between the Company and the Buyer, without the simultaneous physical presence of the Company's representative and the Buyer.
Cart	:	the section of the Account that allows the Buyer/ User to add Products or Services that he/she wishes to purchase at the time of addition or at a later time;
Buyer	:	Any User who places a purchase order on the Website.
Commercial Communication	:	any communication containing general and thematic information, information on Products similar to or complementary to those you have purchased, information on offers or promotions, information relating to Products and Services added in the section "Account /My Cart" or "Wishlist".
Wishlist	:	the section of the Website where the Buyer/ User may add Products or Services that he/she wishes to follow for possible purchase and which he/she can subsequently delete or add to the shopping cart ("Cart").
Review	:	a written evaluation by the owner or beneficiary of a Product or Service, based on their personal experience and ability to make qualitative comments and to say whether or not the Product or Service complies with the specifications mentioned by the manufacturer.
Transaction	:	collection or reimbursement of an amount resulting from the sale of a Product and/or Service by SAVINVIBE or by the Buyer, by using the services of the card processor agreed by SAVINVIBE, regardless of the method of delivery.
User	:	any natural person who is over the age of 16 or a juridical person registered on the Website, who, by completing the account creation process, has given his/her consent to the specific clauses of the Website in the Terms and Conditions of Use section.

Website	:	the online store is hosted at https://www.savinskin.com.

• USE OF THE WEBSITE

The website is offered and available to people who have reached the age of 16. By using the Website, the User warrants that he/she has the legal age and ability to contract the Products and/or services offered by the Company. If all these requirements are not met, access or use of the Website is not authorized. 

In order to access the Website or some of the resources it offers, the User is required to provide certain information that must be accurate, current, and complete.

All information provided for the use of the Website or any of its interactive functions or when registering on the Website is governed by the Privacy Policy and by using the Website The buyer agrees to the company's use of this information in accordance with the Privacy Policy. 

The information available on or through the Website and services provided through or in connection with the Website is intended to inform visitors, Users, or Buyers, and do not constitute medical guidance or advice. The products sold through the Website are intended for cosmetic purposes only and have not been approved by any medical or pharmaceutical authorization body.

Written or verbal communications between the Company's representatives and visitors to the Website, as well as between the Company's representatives and Users or Buyers of the products have a strictly indicative role and cannot be invoked as a reason for return, the decision to purchase any product with all its characteristics (volume, color, performance, results, color matching, etc.) being exclusively the Buyer's.  

The products marketed through the Website are ORIGINAL and come directly from the manufacturers or from distributors authorized by the manufacturers.

It is the responsibility of Users and/or Buyers to determine whether the Products are suitable for their needs, and it is not the obligation and responsibility of the Company.

The information presented on the Website is of a general nature and does not contain all the information relating to the topics referred to therein (including herein the description of the Products), and therefore the Company is not liable for any loss or injury that users and/or buyers (direct or indirect) suffer as a result of the use of information on the Website.  The Company is not liable for any error or omission with respect to this information and users' decision to purchase Products or Services based on this information is their responsibility.

If opinions, advice, recommendations, etc. are posted through the Website by Users, Buyers or any other entities, these opinions, advice, and recommendations are not credited by the Company which does not hold any responsibility regarding their accuracy, precision, or, as the case may be, defamatory nature, etc.

It is forbidden to use the Website to post, upload or transmit obscene or pornographic, threatening, racist, offensive, defamatory material, or to violate any intellectual property law or rights, to harass, offend, threaten or violate the rights of others, to deteriorate or destroy the company's reputation.

Where the Company becomes aware of the existence of such postings, it reserves the right to disclose any such information in accordance with the law and/or to remove, refuse to post, or edit any such information or materials.

The User of the Website must ensure that all persons who will access the Website through his Internet connection are aware of the provisions of the TCU and comply with them.

Usernames, chosen or provided by the Company, passwords, or any other information that is part of the Company's security procedures, must be treated by the User/Buyer as confidential and must not disclose to any other person or entity.

The account on the Website is a personal account of the User or, as the case may be, of the Buyer. The User or the Buyer must not provide access to the personal account to any third party by using their username, passwords or other security information. Accessing the account from a public or shared computer is under the risk and responsibility of the User or buyer.

Any unauthorized access to the username or password, or any other breach of the buyer's account security, shall be notified immediately by the Buyer.

By placing a purchase order on the Website, the Buyer confirms acceptance of the provisions of the TCU and the conclusion of the Contract. Placing the order on the Website is done by navigating the pages of the Website to identify and choose the desired Products, placing them in the shopping cart and pressing the checkout button.

Before being valid, orders registered on the Website are subject to prior approval and the Products placed by the Buyer in the shopping cart are not booked and may be purchased by other Buyers. The validation of the order is notified to the Buyer by sending an electronic message to the e-mail address registered by the Buyer on the Website.

In order to purchase any product or service on the Website, the Buyer is asked for personal financial information, including, without limitation, credit or debit card numbers, and/or other billing information requested by the companies performing payment processing services ("Processor").

By placing a purchase order on the Website, the Buyer warrants that it is authorized to make the purchase and provide the necessary financial information including the Payment Processor.

If a Payment Processor is responsible for the collection, transmission and /or processing of the Buyer's financial information (and, in some cases, for the fulfillment of the order), all payment obligations for the Products ordered on the Website are governed by the conditions of use/service and the privacy policy of the Processor.

The entry into the Company's stock of the Products placed by the Buyer in the "wish list" will be notified to the Buyer by a message sent to the e-mail address registered on the Website within 48 hours from the display on the Website of the Products and/or the available quantity.

The Company reserves the right to disable any username, password or other identifiers regardless of whether they have been chosen by the User or the Company if it believes at any given time that the TCU's provisions have been violated.
 

1. PRODUCTS' PRICE

The prices of the Products displayed on the Website are expressed in Ron and Euros and include VAT.  The prices displayed do not include the value of the courier services related to the delivery of the Products and do not include any taxes, including customs duties or tax charges.

The price of the Products displayed on the Website does not include any additional costs that may occur in the case of purchases from EU countries or NON-EU countries. These costs will be paid by the Buyer separately either to the courier company or to the authorities of these countries.  The price of the Products may be modified by excluding VAT in the case of orders placed from outside Romania.

The prices in Ron displayed on the Website are established based on the purchase price of the Products and the exchange rate at the time of purchase of the Products by the Company.

The prices may be modified by the Company, without being obliged to notify in advance of these changes, in case of price changes by the partners or in case of evolution of the exchange rate.

The price displayed on the Website at the time of accepting the order is the price on the basis of which the supply of the product will be invoiced. In the case of orders placed from Romania for prices displayed in Euro or in the case of payments made from bank accounts in Euro, the price paid will be in RON, calculated at the exchange rate on the day of processing the payment by the bank issuing the credit or debit card.

If the Company finds that there are any errors in the pricing displayed on the Website, it will immediately correct the error and inform the Buyer.

The Company has no obligation to accept or honor an order for a Product whose price has been wrongly set and reserves the right to cancel such order even if it has been accepted or is in progress. The cancellation of the order will be notified to the Buyer by email and the Company will refund all amounts paid by the Buyer after the return of the products.

The Company may make discounts on certain prices, as it deems at any given time, for certain Products, periods of time and limited quantities of such Products.

Also, the Company may offer Buyers gift products or collections of gift products if the orders placed by the Buyers cumulatively meet several conditions:

- Orders exceed the value indicated on the Website,

- Payment is made by credit card or debit card,

- The Buyer waives the right of return for the ordered products.

 

1. INVOICING, PAYMENT AND DELIVERY OF PRODUCTS

 The Company will issue the invoice for the Ordered Products immediately after the approval of the order and will send it electronically to the Buyer's email address registered on the Website.The invoice on paper will be sent to the Buyer with the delivery of the ordered Products. The invoice will be issued, as the case may be, in Ron in the case of orders coming from Romania or Euro in the case of orders coming from outside Romania.

Payment of the ordered Products can be made by bank transfer, by PayPal method, by bank card or cash at the delivery of the Products (cash on delivery). Visa or MasterCard bank cards are accepted for payment.

When selecting the payment options PayPal the Buyer is directed to the Website PayPal for "Login" and to view the payment amount before selecting "Pay Now". 

The payment will be validated and debited to the Website at the time of shipment of the order by the Company.

All bank cards used to purchase the Products shall be subject to prior verification and payment authority by the Processor and/or the card-issuing bank.  If the card-issuing bank used to pay the value of the Products refuses to approve or delays the payment to The Company, The Company is not liable for delaying the delivery or for not delivering the Products.

All transactions made with bank cards are carried out through secure portals that encrypt the bank card data in a protected environment.

The ordered products will be delivered, depending on the date and time of the order, the city and the country of destination, within a period of 1 - 10 working days and will be sent only to the address indicated by the Buyer.  For orders placed from Romania, the delivery of the products will be made in an interval of 1-3 working days.  The delivery of the Products will normally take place between Monday and Friday between 9.00 and 18.00.

Any data that is fixed for the delivery of the Products are approximate and the Company will not be responsible for any delay, regardless of what caused it. The products may also be delivered before the announced delivery date, in compliance with the obligation to inform the Buyer in advance.

If the Company does not have the possibility, for any reason, to send the Products ordered by the Buyer (and in stock) within 14 days of the order, the Buyer has the right to cancel the order, and the Company will refund any amounts the Buyer paid for these Products.

The Company will not be liable for any losses suffered by the Buyer for delayed or unfulfilled deliveries for reasons that concern the Buyer.

If the Buyer or his representative is not at the address indicated for delivery, without the possibility of handing over the goods by the delivery staff, the return costs will be paid to the Company by the Buyer within 5 days from the issuance of the related invoice.

If the Buyer makes a request for a return for the delivery of the goods, he may be obliged to pay to the Company, before delivery, a new shipping cost.

1. RIGHTS AND OBLIGATIONS OF THE BUYER

The buyer has the following rights:

• To receive the ordered products;
• To benefit from Products that correspond to the order placed as described on the Website;
• To receive compensation if the Products are defective or contain defects;
• To return the ordered products or refuse to receive any Ordered Product within 14 days of the date of receiving the Products.
• To receive the full amount paid when placing the order on the Website in case of returning the Products (see the paragraph "Return of products" below).

The buyer has the following obligations:

• To indemnify the Company, at its request, for any expenses, damages, and losses, including legal fees, etc., caused by any violation of the TCU, including if the Website is used by any other person accessing the Buyer's account, with or without the consent thereof;
• Not to substitute the quality (collaborator, employee, agent, etc.) in the relationship with third parties and not to act in any way in the name and on behalf of the Company;
• Not to place orders in bad faith without the real intention to purchase the Products;

 

• GIFT CARDS

Gift cards, printed and virtual, are sold by the Company through the Website with the acceptance and observance by the Customer of the following conditions:

• Gift Cards may be used to purchase any existing product on the Website.
• The Code attributed to a Gift Card expires in 6 months after purchase.
• Gift Cards cannot be reloaded or redeemed in cash.
• If the order value is lower than the value of the Gift Card, the difference in value will remain in the Buyer's balance and the Buyer will be able to use it for future orders.
• If the value of the order exceeds the value of the Gift Card, the Buyer will pay the difference through one of the payment methods indicated on the Website.
• If Products purchased using a Gift Card are returned, the value of the Returned Products, up to the amount of the original Gift Card payment, will be credited to a new Gift Card. The remaining amount of the original Gift Card will be refunded to the Buyer on the bank card used for the transaction.
• The virtual Gift Cards will be sent by e-mail to the Buyer after the complete order has been processed and the payment has been made.
• Promo codes cannot be applied when purchasing Gift Cards unless the Company mentions otherwise.
• The payment of the value of the courier services and the payment of any necessary taxes are also applicable to the purchase of products with a Gift Card.

The Company is not responsible for:

• when a Gift Card is lost, stolen, destroyed, used without permission or delivered to an incorrect or non-existent address. Lost, stolen or destroyed gift cards will not be replaced.
• for delays or failures in the delivery of a Gift Card caused by reasons beyond the Company's control.

The Company reserves the right to cancel or refuse to honor a Gift Card if it deems such action to be reasonably necessary.

The Company reserves the right to modify these terms whenever it deems necessary, any such changes being posted on the Website.

 

• SAVIN'SKIN LOYALTY PROGRAM

The SAVIN'SKIN loyalty report is intended for Buyers in Romania and can be accessed by them after creating a Customer account on the Website.

The loyalty program consists of the Buyer obtaining SAVIN'SKIN loyalty points ("SAVIN'SKIN Points") and using SAVIN'SKIN points to obtain discounts when purchasing the Products existing on the Website.

SAVIN'SKIN points are obtained as follows:

• 1(one) point for every 1(one) leu spent by the Buyer on the purchase of products from the Website,
• 100 points, when the Buyer creates his/her personal account on the Website,
• 100 points, for the tracking (follow) by the Buyer of the Instagram page @savinskin
• 100 points, allocated on the occasion of the Buyer's birthday,
• 100 points, for placing a "review" on the Website,
• 100 points, for subscribing to the Website newsletter.

 

The buyer can accumulate an unlimited number of points through one of the above ways.  The accumulated SAVIN'SKIN points have validity and can be used for a period of 6 months from the date of the last order.

SAVIN'SKIN Points can be "spent" (used) to obtain discounts when purchasing Products as follows:

• 5% discount, for 500 SkinPoints used,
• 10% discount, for 1000 SkinPoints used,
• 15% discount, for 1500 SkinPoints used,
• 20% discount, for 3000 SkinPoints used.

If the Customer returns part or all of the Products from the order for which he "spent" SAVIN'SKIN funds, he/she shall benefit from the right of return, but he/she will lose the SAVIN'SKIN points used.

For purchased products to which a discount is applied from the use of SAVIN'SKIN points, the Customer accumulates new points, the number of points being equal to the value in RON of the products without taking account of the discount received by using SAVINSKIN points.

SkinPoints cannot be used to purchase products that already have discounts displayed on the Website.

The points accumulated by the Customer in case of buying products that already have a discount is equal to the value in RON of the products without taking account of the displayed discount.

When redeeming the points, the Customer cannot use any other promotional codes or offers.
At this moment, The Loyalty Program is solely available for customers who purchase their products in RON.
The Company reserves the right to modify or stop the Loyalty Program at any time without having to substantiate its decision and without offering compensation.
The Company also reserves the right to change the way loyalty points are allocated without having to explain its decision and without offering compensation.

 

1. BEAUTY DEALS

The company can offer for purchase, within the Beauty Deal section, sets of products which sell prices have a value lower than the cumulative value of the price of each product in the set.
*BEAUTY DEALS refers to any type of campaign that offers free gifts per order/product: Gift With Purchase, Gif Box, Gift Product; 

 

Buying any of the products listed in the campaign is the buyer's sole decision, and the Company is not taking responsibility if one or more of the products in the set do not meet its expectations.

The Buyers will receive the free Beauty Box or the products listed in the campaigns only if they respect the steps listed on the page, as follows:
1. The value of the order must qualify to the terms listed on the Beauty Deals Page (each individual campaign has the terms listed on the Beauty Deals Page);
2. The "free gift" of the Buyer's choice must be added to the cart;
3. The associated discount code must be added to the checkout.
Since the products listed in the campaign have a limited stock, we cannot offer the "free beauty deals" for Customers who do not complete the required steps.

In case one of the products selected as a "free gift" is out of stock, SAVIN'SKIN will offer the Buyer an alternative product valued at the same price as the selected gift.
However, the Buyer cannot freely choose any item on the website and is obliged to choose from the provided list, shared by the Seller.

The Products received in the Beauty Box or as a gift cannot be replaced or returned and their value does not accumulate to the loyalty program as points.
The orders which benefit from the Beauty Deals campaigns are non-refundable, in part or in full.
